"I was at the pub last Thursday and got caught in a brawl with my ex girlfriends brother. He kept eyeing me up and bumping into me. He said if he EVER saw me in there again - in HIS pub, then I wouldn't be able to walk out of there cos he would break both my legs. I felt threatened and in defence I pushed him away from me - but he accidentally fell and hit his head off a table edge and is still in Hospital. I didn't mean to cause him any harm and I need legal advice. Please help me…."

Buying or Selling a Home in Scotland - use Scullion LAW

WHAT YOU PAY FOR AT SCULLION LAW

Conveyancing – is the process in which solicitors THOROUGHLY check all the information involved in a house purchase or sale - on your behalf. We ask you to place your trust and money, in the hands of  our experienced professionals in return for a bespoke service. 

Often you are paying for a service which you don't fully understand. There is a lot of paperwork involved and our job is to guide you through the whole process (which can often be complex and stressful) and simplify all the details so that you focus on the JOY of moving house.

We want you to feel the money you invest in return for our TIME, CARE and EXPERTISE is exceptional value due to the high levels of service you receive... You can read more about house purchases on the Law Society of Scotland's website. 

MAKING AN OFFER AND CONCLUDING MISSIVES

The buyer's solicitor makes a written offer to buy and the seller's solicitor accepts it in writing. The Solicitors then exchange letters clarifying the details and conditions of the offer and acceptance. These letters are known as missives. Once everything is agreed the MISSIVES CONCLUDE in a binding contract, which agrees the 'DATE OF ENTRY'. The seller can then not accept a higher offer from someone else. (If the buyer can not fulfil the obligations set out in the missives they may be liable to pay the seller thousands of pounds in damages). Therefore before making an OFFER the buyer must get legal advice and organise their finances to meet the purchase price. Until the missives are concluded, either the buyer or seller can withdraw and walk away without any penalty.

HOME REPORT

The seller's (estate agent) will provide the potential buyers with a copy of the 'Home Report' normally within 9 days of it being requested. It details the condition of the property and notes any repairs that may be required etc. The buyer should double check all the information with their solicitor (valuation and rebuilding costs) for insurance purposes. If you like the property you should get estimates for completing any of the 'urgent' works prior to putting in an offer. Also consider if you can cope with the upheaval of the repairs and use the feedback to decide what your 'maximum offer' would be.

Surveyors can also provide seller's with a standard mortgage valuation report. So buyer's are encouraged to check that the report is acceptable to their lender. The Home Report must not be any older than 12 weeks when the property goes on the market. It normally includes: council tax band; issues that have affected the property such as storms and fire; alterations; extensions; and details of any notices that affect the property. The Energy Report gives the house an energy efficiency rating which is the basis of running the property. This should include an Energy Performance Certificate. (There are a few exceptions when a Home Report is not necessary - please speak to your solicitor ).

NEW HOMES

The procedure for buying a new home differs from buying an existing one. The home advertised may not have been built yet and is normally set at a fixed price. It is the builder who normally sets out the conditions on which they are prepared to sell the property so you should get legal advice before you accept their terms/ conditions/ offer because your acceptance is legally binding.

CONVEYANCING 

When the missives are concluded and you have agreed a contract with the seller, Scullion LAW will carry out the conveyancing (which is the process of transferring the ownership - title- of a property from the seller to the buyer). Your solicitor will investigate the property and examine the title deeds that applies to the property. They will check the land certificate and deeds to make sure the seller actually owns the property and tell you about any burdens (limitations or legal restrictions) or servitudes (that allow someone to use the land or prevent you making use of it). Your solicitor will also make sure that any existing standard security (mortgage) over the property is paid off when the house is transferred to you.

LIFE INSURANCE AND MORTGAGE

Following upon the huge success of last year's support for this very worthwhile charity, we're launching our "Free Wills" scheme at the beginning of February and it'll run right through to the end of March. Scullion LAW School Debating Cup: The competition is hotting up with Holy Cross and Strathaven Academy in the final. We're looking forward to a closely contested debate to be held in the Council Office in Hamilton on 25th November.

COMMUNITY INVOLVEMENT


We at #ScullionLAW are delighted to be supporting Marie Curie this year - we have selected this great cause because someone dear to us at Scullion LAW passed away from a terminal illness several years ago. In her final days, Margaret was cared for by Marie Curie nurses. Only £20 will help support one hour of care within a hospice or in the home of someone that is in need. We also helped FFAMS Families and Friends against Murder and Suicide. They held their annual 'McGilvary Football Tournament' in honour of Paul Gerard who was murdered several years ago. The money raised on the day went towards other families affected by murder and suicide throughout Lanarkshire. This is a great cause and we urge others to get in touch with FFAMS. We are happy to support FFAMS.

Scullion LAW Finalised for the prestigious 'Community Contribution Award 2015'. We were honoured to be shortlisted against Digby Brown (they sponsored the Commonwealth Games) for our efforts in the local community of #Lanarkshire where we have been based for over 35 years. We are now in our 6th year working with the local councils in the North and South to host an annual Interschool's Debating Cup. It has been hugely successful over the years, creating opportunities for young pupils to grow in confidence speaking publicly and debating against other schools in a healthily competitive environment, teaching them invaluable lifeskills to equip them for the future. We are proud of all the pupils that have taken part over the years... some have gone on to pursue careers in LAW. In addition to our Annual Interschools Debate - we work closely with the local community and take individuals that have left school, and train them up within our administration department to enable them to complete an 8 week work experience programme. Once they finish the placement - we normally keep them on as staff. So far Ian, Lisa, Stacey, Louise, Stewart and a few others have come through the 'Routes To Work' programme. We will continue to help local kids realise their potential within #ScullionLAW- we believe that by encouraging and guiding youngsters they will recognise their own strengths and succeed.

Thank you for supporting us in 2012!

This has been a very challenging year, but we would like to share some of our successes which would not have been possible without your continued support.

Awards

Our team have continued to impress with our civil paralegal Valerie Troop winning the 2012 Scott & Co Awards Paralegal of the Year. Robert Sheridan also deserves a special mention for being a Finalist in the Specialist Lawyer of the Year for his work in Road Traffic defence which is an increasingly complex and competitive area of law. Stopped by the Police? Don’t panic, call us on 0800 11 12 13!

Later in the year we were delighted to raise more than a few eyebrows when we were short listed in no less than three separate categories at the Law Awards of Scotland in September. The lavish event comprised legal practices of all shapes and size competing over any array of sought-after awards that recognise excellence. Scullion LAW were nominated for the Best Criminal team, Best Support team and Best Trainee Solicitor for the firm’s Jason Stark, but it was not to be our night. Although eager to repeat past-successes at the ceremony, having won Criminal Law Firm of the Year in 2010, it was fantastic to make it to the final.

Meet our Solicitor Advocate – Rhonda Anderson

We are also delighted to announce that Rhonda has qualified as a Solicitor-Advocate, allowing us to defend clients in the highest courts in the country. Rhonda has already achieved great successes in both Glasgow and Edinburgh High Courts with coverage in the national press. This means that no matter the charge, Scullion Law can now defend clients in every court throughout Scotland.

Expansion into Airdrie

Summer 2012 saw us acquire the established Fagans Solicitors in Airdrie. This marks an exciting step forward for Scullion LAW; Stephen Fagan’s expertise, strong court room persona and determination to get the right result has been a great addition to our civil and family department. We also bought the Ross Harper brand – watch this space…

New Clients – Business Law and Property

As our Firm grows, so too does our client base. Martin Carey has done a steadfast job in building our business law department. From start-up issues like incorporation and leasing premises to supply agreements, debt recovery and employment advice we offer our clients solid legal guidance at better value than city firms.

Our clients have been busy, one setting up new national estate agency group, others purchasing dental and pharmacy businesses as well as clients consolidating in the licensed trade. Our partnership with Business Gateway has brought start ups clients with exciting plans! Our Property team have also worked incredibly hard in tough conditions and won new business from estate agents and been instructed by a national builder. Well done!

Fatal Accident Inquiry

Our solicitors appeared at a lengthy Fatal Accident Inquiry to find answers for our client whose child had died while in care. Our determination to uncover the truth showed up systematic failures, consequently affording our client some peace in knowing the truth about the preventable circumstances surrounding her child’s death. Hopefully lessons will be learned to avoid a similar tragedy.

Commitment to the Community

We take our involvement in the community seriously and 2012 has been no different.

We have had over 20 students from local schools and universities working with us, learning about using the law to help the vulnerable. We also helped set up the Friends of Cadzow Glen, and took part in the summer clean up of the Glen for the community as well as committing to local charities such as St Andrew’s Hospice.

We are particularly pleased with how our third annual Schools Debating Cup unfolded. Open to schools in both South and North Lanarkshire; 16 schools competed over a series of closely fought debates at our offices before the Final was played out in front of a packed banqueting hall at South Lanarkshire Council Headquarters. 2011 winners Uddingston Grammar narrowly defeated Abronhill Academy in front of a judging panel made up of Margaret Mitchell MSP, Ian Leitch CBE and the Glasgow University Debating Society. The winners will go on a tour of Tunnocks Factory in Uddingston as well as benefitting from work experience with us.

Winners of Scullion Law Debating Cup Finals 2011


Uddingston Grammar narrowly beat Biggar High to take the cup at the Scullion Law, Schools’ Debating Championship Final which was held at the Banqueting Suite in South Lanarkshire’s Headquarters on the 7th December. Ten schools took part this year and every pupil was given an award in recognition of their efforts.
This prestigious event, organised in conjunction with South Lanarkshire Council encourages pupils to develop skills which can be taken forward into their adult, social and working lives.
Larry Forde, Executive Director of South Lanarkshire praised the excellent standard of debating. Calderside Academy provided street dancers while judges, Ian Leitch LLb. CBE, John McKee and Ross Mitchell, Glasgow University Debating Society and Margaret Mitchell MSP were deciding on the winner. It was so close that in the end the chairman had to use his casting vote.
This is the second year of the Challenge which is part of Scullion Law’s commitment to the community. All the pupils who took part have witnessed live debate at
Hamilton Sheriff Court
and gained skills in several areas such as research, originality of thought, the formation and presentation of an argument and the confidence to deliver it in public. This will be invaluable to them no matter what career they decide to pursue. 
More than 30 young people have been given work experience this year within the Scullion Law offices at 105 Cadzow Street, Hamilton.
The winners will be taken on a tour of Tunnocks factory as part of their prize.

Scullion LAW taking part in Will Aid!

We are pleased to announce that during the month of November we will be taking part in a charitable initiative known as Will Aid. Will Aid has a simple yet compelling objective to encourage everyone in the UK to get their affairs in order by drawing up their Will and at the same time help 9 of the UK's best loved charities.

Instead of charging for drawing up a basic Will, we will waive our usual fee and instead ask you the client to make a donation to Will Aid. The suggested minimum donations are £40 for a codicil, £85 for a basic single Will or £125 for a pair of basic mirror Wills.

You will gain peace of mind, knowing your affairs are in order, and thousands of people in need will gain the skills, tools and support they need to improve their lives for just a suggested donation of £85 for a single Will.

Semi-Final Debate 2011


ScullionLAW is proud to be helping young people in Lanarkshire gain positive life skills by participation in the ScullionLAW Debating Cup 2011. Ten schools from North and South Lanarkshire have taken part this year and the debating teams were afforded a marvellous opportunity to visit the Hamilton Sheriff Court and witness live debate in the Courts of Law.

Round One of the Scullion Debating Cup was held on October 5th 2011 where experienced debaters judged the pupils on their performance. Six teams have gone forward to the next round. The aim of the competition is for pupils to gain skills in several areas; particularly in research, original thought, the formation and presentation of an argument, and the confidence to deliver it. This will be invaluable no matter what career they decide to pursue. 
  
The Semi Final was held on Wednesday 2nd November, with representatives from Our Lady’s High, Larkhall Academy, Biggar High, Uddingston Grammar, John Ogilvy High and St Andrew’s and St Brides High School each competing to reach to Final.

Congratulations to Bigger High and Uddingston Grammar for getting through to the Final! This will be held at South Lanarkshire Council Headquarters on 7th December.
